englischThe author calls for a functional interpretation of the different uses of the term "employee" in the law of the European Union. While the Lawrie-Blum test was the result of an observational interpretation and could serve as a starting point for the definition of the term, it was unsuitable as a tool to interpret the term employee in all European legal acts alike. Instead, a transparent functional approach could promote interpretations of the terms that consider their legal consequences as well as promote a better understanding and acceptance of decisions of the European Court of Justice.
Der Verfasser plädiert für ein funktionales Verständnis von den Arbeitnehmerbegriffen im Unionsrecht. Die sogenannte Lawrie-Blum-Formel, Ergebnis nur beobachtender Begriffsbildung, könne einzig ein Ausgangspunkt für die Begriffsbestimmung sein, sei aber darüber hinaus ungeeignet für ein rechtsaktübergreifendes Begriffsverständnis. Demgegenüber würde eine transparent funktionale Betrachtung das Verständnis und die Akzeptanz von Entscheidungen des Europäischen Gerichtshofs erhöhen und würde auch eine nachvollziehbar rechtsfolgenangemessene Begriffsbildung gewährleisten.
