englischThis study raises the question of which law currently exists to allow people with disabilities non-discriminatory access to healthcare. Against the background of statistical evidence which reveals that accessible care is neither provided satisfactorily by healthcare services and facilities nor by social insurance agencies, the study indicates that various regulations in public and civil law require disabled people to be given access to healthcare and authorities to take reasonable steps to ensure this and to avoid discrimination against them, especially when the UN Convention on the Rights of Persons with Disabilities is taken into account. This study focuses on how the parties involved in this issue (people and associations of people with disabilities as well as public author-ities) can support and enforce the application of the existing law which guarantees the disabled problemfree access to healthcare. Moreover, it suggests ways in which the legal situation can be amended and developed further.
Das Werk befasst sich mit dem Recht einer barrierefreien Gesundheitsversorgung für Menschen mit Behinderung. Vor dem Hintergrund mangelnder Barrierefreiheit von Leistungserbringern (Ärzte, Krankenhäuser, Rehabilitationseinrichtungen, etc.) und Leistungsträgern (z.B. Krankenkassen) wird der Frage nachgegangen, welche normativen Vorgaben in diesem Bereich existierten. Unter Berücksichtigung der UN-Behindertenrechtskonvention wird deutlich, dass bereits vielfältige Normen des öffentlichen Infrastruktur- und Leistungsrechts sowie des Zivilrechts Barrierefreiheit und angemessene Vorkehrungen für eine diskriminierungsfreie Versorgung fordern. Im Schwerpunkt werden die besonderen Instrumente zur Durchsetzung des geltenden Rechts näher behandelt. Die Perspektive liegt hier auf den Handlungsoptionen der betroffenen Menschen mit Behinderung, Interessensverbänden und staatlichen Stellen. Abschließend werden Vorschläge zur Anwendung und Weiterentwicklung des Rechts aufgezeigt.
