englischWith regard to the most recent doping scandals and the increasing economic importance of sports, this thesis highlights the potential of criminal law to diminish the problem of doping in professional sports.

Its first part presents a comprehensive analysis of the already established instruments of German criminal law both inside and outside of the Criminal Code, as far as it covers doping by third parties or the athlete himself. The second part discusses the legal obstacles for new legislation, especially the doctrine of the protection of legal goods and constitutional restrictions, but also considerations of criminal policy. This is followed up by a review of several relevant proposals for new legislation, based upon the findings obtained. Finally, the author comes up with his own proposal of a new provision which penalises doping by the athlete, protecting the legal good of property.
