englischBlockchain revolutionizes existing transaction systems and offers many advantages thanks to its distributed structure and permanent linking of data blocks. Due to its technical implementation, it is fundamentally at odds with the GDPR. Taking into account the different design options of the blockchain, the work identifies relevant areas of tension, in particular with regard to the rights of data subjects. At the same time, regulatory recommendations for action are given in order to enable a legally secure use of the technology in practice and not to slow down technological progress. Overall, it is clear that the requirements of the GDPR are already partially fulfilled, but at the same time also lead to contradictions.
Blockchain steht für eine Revolutionierung bestehender Transaktionssysteme und bietet durch eine verteilte Struktur und dauerhafte Verkettung der Datenblöcke viele Vorteile. Aufgrund der technischen Umsetzung steht diese grundsätzlich im Widerspruch zur DS-GVO. Die Arbeit identifiziert unter Berücksichtigung der unterschiedlichen Ausgestaltungsmöglichkeiten der Blockchain relevante Spannungsfelder, insbesondere bezogen auf die Betroffenenrechte. Zugleich werden regulatorische Handlungsempfehlungen gegeben, um einen rechtssicheren Einsatz der Technologie in der Praxis zu ermöglichen und den technologischen Fortschritt nicht auszubremsen. Insgesamt zeigt sich, dass die Anforderungen der DS-GVO teilweise bereits erfüllt werden, jedoch gleichzeitig auch zu Widersprüchen führen.
