englischThe study offers a comprehensive examination of the law applicable to blockchain networks and crypto assets. The objective is to find out whether private international law, which traditionally searches for the 'seat' of a legal relationship, is able to capture these inherently transnational phenomena. The focus is on the one hand on the legal relationships between the participants of blockchain networks, and on the other hand on the legal transactions under the law of obligations and in rem in connection with the issuance and trading of crypto assets. The study also considers the recent reform of German (international) securities law by the eWpG. Finally, it develops a proposal for a future blockchain-specific conflict-of-laws rule.
Die Arbeit untersucht das auf Blockchain-Netzwerke und Krypto-Token anwendbare Recht. Ziel ist es, herauszufinden, ob das Internationale Privatrecht, das traditionellerweise nach dem "Sitz" eines Rechtsverhältnisses sucht, in der Lage ist, diese von Natur aus transnationalen Phänomene zu erfassen. Im Mittelpunkt stehen zum einen die Rechtsbeziehungen zwischen den Teilnehmern von Blockchain-Netzwerken, zum anderen die schuldrechtlichen und dinglichen Geschäfte im Zusammenhang mit der Emission und dem Handel von Krypto-Token. Die Arbeit berücksichtigt auch die jüngste Reform des deutschen (Internationalen) Wertpapierrechts durch das eWpG. Schließlich entwickelt sie einen Vorschlag für eine künftige Blockchain-spezifische Kollisionsnorm.
