englischIt can by no means be taken for granted that companies – even those in which the public sector has a stake – always comply with “law and order”.

In particular, the principle of the rule of law and the ­principle of democracy require that the state not only acts “itself” in accordance with the law, but that it must also be able to ensure that the corporations in which it participates as a shareholder in order to fulfill its tasks behave in accordance with the law and the rules.

The state has a compliance responsibility for its public ­companies.

Whether it can fulfill this responsibility with regard to its mixed-economy companies depends on their legal form.
