englischThe work addresses the question how far parental rights in the digital world reach and where limits are (must be) imposed by the state in order to balance them against the rights of the child. The subject of investigation are thereby the phenomena of sharenting and digital helicopter parenting. The legal analysis bases mainly on a constitutional, European and public international law perspective, but recurs also on national laws to analyse the actual implementation of the afore found human rights requirements. In particular, the german youth media protection (JuSchG) act and the youth labour protection act (JArbSchG) show certain gaps for the protection of children´s rights that need to be covered.
Die Autorin befasst sich mit der Frage, wie weit die elterlichen Rechte in der digitalen Welt reichen und wo der Staat Grenzen setzt, bzw. setzen muss, um sie mit den Rechten des Kindes in Einklang zu bringen. Untersuchungsgegenstand sind dabei die Phänomene des Sharenting und Digital Helicopter Parenting. Die rechtliche Analyse basiert vor allem auf Verfassungs-, Europa- und Völkerrecht, greift aber auch auf nationale Gesetze zurück, um die tatsächliche Umsetzung der auf der vorherigen Stufe gefundenen menschenrechtlichen Anforderungen zu überprüfen. Dabei zeigen insbesondere das Jugendmedienschutzgesetz (JuSchG) und das Jugendarbeitsschutzgesetz (JArbSchG) Lücken für den Schutz der Kinderrechte auf, die es zu schließen gilt.
