englischThe work examines the German Whistleblower Protection Act against the background of the EU Whistleblowing Directive and the groundbreaking case law of the ECtHR. To this end, the development of whistleblower protection is discussed from a legal and legal policy perspective, with a particular focus on synergies between whistleblower protection and new business ethics concepts such as corporate social responsibility (CSR). With a view to the practical protection of whistleblowers in the workplace and the implementation of the Whistleblower Protection Act, questions of co-determination in the workplace are examined.
Die Arbeit betrachtet das deutsche HinSchG vor dem Hintergrund der EU-Whistleblowing-Richtlinie und der wegweisenden Rechtsprechung des EGMR. Hierfür wird die Entwicklung des Hinweisgeberschutzes in rechtlicher wie rechtspolitischer Hinsicht diskutiert, wobei insbesondere Synergien von Hinweisgeberschutz und neuen wirtschaftsethischen Konzepten wie der Corporate Social Responsibility (CSR) aufgezeigt werden. Mit Blick auf den praktischen Schutz von Hinweisgeber:innen im Betrieb und die Umsetzung des HinSchG werden Fragestellungen des Mitbestimmungsrechts thematisiert.
