englischThe book provides a legal analysis of the Colombian peace process with a concrete proposal for the dealing with crimes in connection with the armed conflict. The author initially introduces to the fundamentals of the principle of opportunity on a German and international level. This is followed by a description of the historical background of the Colombian peace process and of the extent to which the principle of opportunity applies in Colombia. He also addresses Colombia’s status in the international legal order and the consequences of this status quo on the post conflict reconstruction. The main part of the work consists of a study on the legitimacy of (future) alternative options of dealing with the past, such as amnesties or the principle of opportunity. The author presents in detail suitable measures, implementation criteria, competences and powers of control. He finally verifies the compatibility of his considerations with different international obligations applicable to Colombia.

Johann Melchior Raiser führt zunächst in Grundlagen des Opportunitätsprinzips auf deutscher sowie internationaler Ebene ein. Es folgt eine Darstellung der historischen Hintergründe des kolumbianischen Friedensprozesses und der Geltung des Opportunitätsgrundsatzes in Kolumbien. Der Autor betrachtet ferner die Stellung Kolumbiens im internationalen Rechtssystem und die Konsequenzen dieses Ist-Zustandes für den Aufarbeitungsprozess. Den Hauptteil des Werks bildet die Untersuchung der Legitimität (künftiger) alternativer Aufarbeitungsoptionen wie Amnestien oder eben des Opportunitätsprinzips. Raiser arbeitet taugliche Maßnahmen, Anwendungskriterien sowie Kompetenzen und Kontrollbefugnisse heraus und widmet sich abschließend der Vereinbarkeit seiner Überlegungen mit den diversen völkerrechtlichen Verpflichtungen Kolumbiens.
