englischThe Act on Corporate Due Diligence Obligations in Supply Chains (Supply Chain Act) represents a new type of human rights protection that makes German companies responsible for production conditions worldwide through national requirements. Due to its novelty, numerous questions arise, and this work offers initial suggestions in selected areas to answer them. The focus is on the extent to which a possible human right to (drinking) water is protected by the Supply Chain Act and how the legal requirements for the internal implementation of the due diligence obligations of the Act affect this. Specific aspects of the right to water as well as general facets of the Act are discussed.
Das zum 1.1.2023 in Kraft getretene LkSG stellt eine neue Art des Menschenrechtsschutzes dar, der durch nationale Vorgaben deutsche Unternehmen für Produktionsbedingungen weltweit in die Pflicht nimmt. Aufgrund seiner Neuheit stellen sich zahlreiche Fragen, zu deren Beantwortung dieses Werk erste Vorschläge in ausgewählten Bereichen anbietet. Schwerpunktmäßig wird untersucht, inwieweit ein mögliches Menschenrecht auf (Trink-)Wasser durch das LkSG geschützt wird und wie sich die gesetzlichen Vorgaben zur unternehmensinternen Umsetzung der Sorgfaltspflichten des LkSG insoweit auswirken. Dabei werden spezielle Aspekte des Rechts auf Wasser wie auch allgemeine Facetten des Gesetzes thematisiert.
