englischThe network of independent agencies for the regulation of the European internal electricity market creates numerous challenges for the democratic legitimation of administrative activities. The author addresses these challenges in this study and compares the concepts of legitimacy underlying the German constitution and the EU treaties. On this basis, the author shows which elements and mechanisms can be used to reduce the conflicts resulting from the different conceptions of legitimacy in the context of the ongoing legislative development of the regulatory framework for grid-based energy, which is now pending at the national level.
Der Verbund unabhängiger Behörden zur Regulierung des europäischen Strombinnenmarktes schafft zahlreiche Herausforderungen für die demokratische Legitimation von Verwaltungstätigkeit. Diesen Problemstellungen widmet sich der Autor in der vorliegenden Untersuchung und stellt dabei zugleich die dem deutschen Grundgesetz und den Unionsverträgen zugrunde liegenden Legitimationskonzepte gegenüber. Davon ausgehend wird aufgezeigt, welche Elemente und Mechanismen eingesetzt werden könne, um die aus den bisherigen unterschiedlichen Legitimationsvorstellungen resultierenden Konflikte im Rahmen der nun auf nationaler Ebene anstehenden gesetzgeberischen Weiterentwicklung des Regulierungsrahmens für leitungsgebundene Energie abzubauen.
