englischThis thesis deals with the admissibility of banks charging fees for transactions. In this context, the author examines the influence of European payment services and payment account law on regulating the general terms and conditions in this respect under German law. He comes to the conclusion that, to a large extent, the previous ruling by the Federal Supreme Court can no longer be upheld, as charging banking fees is permitted to a greater extent than previously due to European legal requirements. This is exemplified by individual fee clauses in the banking industry, such as the charging of fees for reissuing account statements or cash withdrawals at the counter. Even if further fees may be charged, the author believes that regulating both the level of the fees as well as the instruments of surprise and transparency is increasingly becoming the focus of judicial reviews into bank charges.
