Both practitioners and courts are regularly confronted with these and other questions about the European Works Council. This study therefore analyses the possibilities and limits of the European Works Council's involvement, which differ depending on the form in which the works council body is set up. The question of whether the European Works Council can assert a temporary claim for injunctive relief to ensure participation if it has not been (correctly) involved is highly controversial.
