Both practitioners and courts are regularly confronted with these and other questions about the European Works Council. This study therefore analyses the possibilities and limits of the European Works Council's involvement, which differ depending on the form in which the works council body is set up. The question of whether the European Works Council can assert a temporary claim for injunctive relief to ensure participation if it has not been (correctly) involved is highly controversial.
Welche Beteiligungsrechte hat der Europäische Betriebsrat im Rahmen von grenzüberschreitenden Betriebsänderungen und (wie) kann er diese wirksam durchsetzen? Mit diesen und weiteren Fragen des europäischen Betriebsverfassungsrechts sehen sich sowohl die Praxis als auch die Rechtsprechung regelmäßig konfrontiert. Die Arbeit untersucht daher die Möglichkeiten und Grenzen der Mitwirkung des Europäischen Betriebsrats, die sich je nach Errichtungsform des Betriebsratsgremiums unterscheiden. Überaus umstritten ist dabei die Frage, ob der Europäische Betriebsrat einen zeitlich begrenzten, beteiligungssichernden Unterlassungsanspruch geltend machen kann, wenn er nicht (korrekt) beteiligt worden ist.
