englischThe ECJ’s ruling on Huawei Technologies/ZTE of 16th July 2015 is of immense importance in the field of patent litigation. According to this ruling, the patentee of a standard essential patent who has given a commitment to the standards organization to grant third parties a licence for that patent on FRAND-terms has to meet certain obligations prior to filing a lawsuit. This thesis summarises the ECJ’s decision in a five phase model and defines its relationship to the German Federal Court’s (BGH) Orange Book Standard of 2009, which favoured the rights owner.
Die Huawei Technologies/ZTE-Entscheidung des EuGH vom 16.7.2015 ist für den Bereich „Patent Litigation“ von herausragender Bedeutung. Nach dieser Entscheidung werden dem Rechtsinhaber eines standardessentiellen Patents, der gegenüber einer Standardsetzungsorganisation eine FRAND-Erklärung abgegeben hat, besondere Obliegenheiten im Rahmen der gerichtlichen Geltendmachung seiner immaterialgüterrechtlichen Abwehransprüche auferlegt. Die Dissertation fasst die EuGH-Entscheidung in ein 5-Phasen-Modell zusammen und löst das Verhältnis zu der rechtsinhaberfreundlichen Orange-Book-Standard-Entscheidung des BGH aus dem Jahr 2009.
