This work examines the extent to which a change in the status-related protection concept in labour law could enable an appropriate distribution of opportunities and risks in a modern and dynamic world of work on the basis of the framework provided by fundamental and European law and against the background of the functional conditions of labour and social law in the market economy.
Die eng mit dem Bild des industriellen Arbeitnehmers verknüpfte Gestaltung des persönlichen Anwendungsbereichs des Arbeitsrechts steht durch eine sich im technologischen Fortschritt und gesellschaftlichen Wandel stetig verändernde Arbeitswelt unter starkem Anpassungsdruck. Die Arbeit untersucht anhand des grund- und europarechtlich vorgegebenen Gestaltungsrahmen und vor dem Hintergrund der arbeits- und sozialrechtlichen Funktionsbedingungen in der Marktwirtschaft, inwiefern eine Veränderung des statusbezogenen Schutzkonzeptes im Arbeitsrecht eine sachgerechte Verteilung von Chancen und Risiken in einer modernen und dynamischen Arbeitswelt ermöglichen könnte.
