englischInsight into an important aspect of the French reform of the law of obligations of 2016. The development of the topic in France is examined and in particular the standardization of a general pre-contractual duty to inform, with which pioneering work was done. It is taken into account that information duties do not only have a preventive effect, but are multifunctional and that a distribution of the information risk is often achieved indirectly. This is illustrated by a comparative legal analysis based on facts from case law under the law of sales, which shows the different handling of the problem in German law, UN sales law and CESL.
