englischSince the Federal Labour Court has set aside the principle of tariff units it is particularly interesting to see how the newly acquired collective tariff pluralism can be accommodated at company level by the BetrVG. Against this Background of constitutional problems the main focus is regarding whether statutory regulations already indicate a tariff unit or that these constitutional issues can be resolved by existing statutory regulations. This fundamental collective issue has to be raised for all those who correctly advocate the dismissal of the principle of tariff units. But even for those who don´t consider the solution of tariff units as possible, this work may provide a new diverse approach.
