englischThe German penal system is increasingly guided by recommendations (so-called soft law) of the United Nations and the Council of Europe. Although this soft law has no legally binding effect, it represents a common standard supported by all member states that points the way forward for the design of the penal system. In addition to a review of the consideration of soft law in the German penal system in legislation and jurisprudence, the thesis deals mainly with a systematic analysis of soft law in relation to the penal system. Overall, it is shown that soft law serves as an important source of inspiration for new legislation and reforms and contributes to the further development of the law.
