The scope of such an obligation can be deduced from the provisions in Sections 327 et seq. BGB, because it is predetermined by the Directive (EU) 2019/770. The study deals with the question of how the supply of digital products relates to the characteristic obligations of the types of contract regulated in the BGB. This has a direct impact on the scope of application of Sections 327 et seq. BGB and Sections 433 et seq. BGB.
Gegenstand aller von den §§ 327 ff. BGB erfassten Verträge ist nach § 327 Abs. 1 S. 1 BGB eine Bereitstellung digitaler Produkte. Der Inhalt einer derartigen Verpflichtung lässt sich aus der Regelung in den §§ 327 ff. BGB ableiten, weil er durch die Richtlinie (EU) 2019/770 vorgezeichnet ist. Die Autorin setzt sich mit der Frage auseinander, wie sich die Bereitstellung digitaler Produkte zu den charakteristischen Leistungspflichten der im BGB geregelten Vertragstypen verhält. Dies wirkt sich unmittelbar auf den wechselseitigen Anwendungsbereich der §§ 327 ff. BGB und der §§ 433 ff. BGB aus.
