englischIn employment law, the shaping of employment relationships by third parties may be considered normal practice. In addition to trade unions, employers’ associations, and representatives of company statutes, other associations exist that also play a role in this respect. Sports associations and associations for other professions especially endeavour to influence the rights and obligations of employment with their own extensive regulations. In contrast to collective bargaining law and industrial constitution law, there are, however, no legal rules regarding the commitment of employers and employees to such regulations. With this in mind, the author examines under what conditions and with what implications the contractual parties can be bound to such association regulations. In this context, the author also considers the issue of sanctions as well as arbitration.
