englischBased on a comparison of the English, US and German legal systems, the work examines the possible use and benefits of dissenting opinions in commercial arbitration. Drawing on commentary, case law and an expert survey, a regulatory proposal is developed that aims to benefit from the experience of English and U.S. state courts and arbitral tribunals in frequently dealing with dissenting opinions. The dissertation questions the skeptic view of German arbitration practitioners on an instrument that has become an integral part of other legal systems and examines whether such skepticism can have a place in international arbitration.
