englischThe work deals with the confiscation of the proceeds of crime within the framework of asset recovery law, in particular non-conviction-based confiscation. It provides a comparative analysis of international and EU legislation as well as the national confiscation models in Germany, Italy and Greece. It focuses on Directive 2014/42/EU, Regulation (EU) 2018/1805 and the currently discussed proposal for a Directive of May 2022. The three country reports each provide an overview of the national confiscation models, their history and legal nature, as well as the substantive and procedural requirements for ordering the national NCBC models. The main target groups are legislators, lawyers and judges.
