englischThe work deals with the confiscation of the proceeds of crime within the framework of asset recovery law, in particular non-conviction-based confiscation. It provides a comparative analysis of international and EU legislation as well as the national confiscation models in Germany, Italy and Greece. It focuses on Directive 2014/42/EU, Regulation (EU) 2018/1805 and the currently discussed proposal for a Directive of May 2022. The three country reports each provide an overview of the national confiscation models, their history and legal nature, as well as the substantive and procedural requirements for ordering the national NCBC models. The main target groups are legislators, lawyers and judges.
Die Arbeit befasst sich mit der Einziehung von Taterträgen als Teil des Vermögensabschöpfungsrechts, insbesondere mit der Einziehung ohne Verurteilung. Sie bietet eine rechtsvergleichende Analyse der internationalen und EU-Rechtsvorschriften sowie der nationalen Einziehungsmodelle in Deutschland, Italien und Griechenland. Im Fokus stehen die RL 2014/42/EU, die VO (EU) 2018/1805 und der aktuell diskutierte Richtlinienvorschlag vom Mai 2022. Die drei Länderberichte geben jeweils einen Überblick über die nationalen Einziehungsmodelle, ihre Geschichte und Rechtsnatur sowie die materiellen und prozessualen Anordnungsvoraussetzungen der nationalen NCBC-Modelle. Hauptadressaten sind Gesetzgeber, Rechtsanwälte und Richter.
