englischWith his study, the author examines the appropriateness of the so-called extended revision in German criminal procedure. To this end, the overall development of this variant of appeal is revisited since the Code of Criminal Procedure 1877 came into force. The study outlines how the matter of legal error came to dominate within this appeal and how the matter of procedural error declined. The development is put into context, e.g. for appeal or for general apprenticeship (besser: „doctrins of“ oder „teachings of“ (in) legal remedies. The possible roots of this development are investigated and procedural economy is identified as its decisive cause. The author attaches particular importance to the practical effects of this development. For this purpose, the results of a survey among judges are evaluated. On this basis, the author makes a differentiated, sometimes critical judgment about the extended revision and its effectiveness. Proposals for a reform are made.

Prof. Dr. Wolfgang Wohlers, GA 4/2021, 230
