englischThis study represents the first comprehensive empirical research project into the principal ground for pre-trial detention: the risk of flight. Drawing on criminology, criminal procedural law and German constitutional law, it examines the necessary theoretical and practical considerations in the judicial assessment of a suspect’s risk of flight. How can one predict a suspect’s risk of flight? How often does the prediction need to be proven to be correct in order for the practice to be considered sufficiently reliable? This study offers practical solutions to these questions, as well as to additional challenges such as discriminatory practices and issues of EU Law. The findings are based on both quantitative and qualitative research, which has been conducted nationwide and sets new standards with regard to both the number of examined cases and its practical relevance.
Das Werk stellt die erste umfassende empirische Untersuchung des zentralen Untersuchungshaftgrundes der Fluchtgefahr dar. Aus Kriminologie, Strafprozess- und Verfassungsrecht wird hergeleitet, wie sich die Fluchtgefahrentscheidung des Richters theoretisch und praktisch zusammensetzen sollte. Anhand welcher Faktoren lässt sich die Flucht Beschuldigter im Einzelfall prognostizieren? In wie vielen Fällen muss sich die Fluchtprognose ex post als richtig herausstellen, um von einer ausreichenden Prognosesicherheit sprechen zu können? Auf diese Fragen und zu weiteren Problemen wie Diskriminierungstendenzen und europarechtlichen Aspekten in der Praxis werden praktisch handhabbare Antworten gefunden. Die Erkenntnisse basieren auf bundesweit durchgeführter quantitativer wie qualitativer Forschung, die in der Zahl untersuchter Verfahren und praktischer Relevanz auf diesem Gebiet Maßstäbe setzt.
