englischThis study represents the first comprehensive empirical research project into the principal ground for pre-trial detention: the risk of flight. Drawing on criminology, criminal procedural law and German constitutional law, it examines the necessary theoretical and practical considerations in the judicial assessment of a suspect’s risk of flight. How can one predict a suspect’s risk of flight? How often does the prediction need to be proven to be correct in order for the practice to be considered sufficiently reliable? This study offers practical solutions to these questions, as well as to additional challenges such as discriminatory practices and issues of EU Law. The findings are based on both quantitative and qualitative research, which has been conducted nationwide and sets new standards with regard to both the number of examined cases and its practical relevance.
