englischIn many cases the complainant invokes in his favour more than one constitutional right. These cases raise questions of constitutional rights concurrence. The thesis is a contribution to the general concurrence doctrine of constitutional rights. It focuses on the system of constitutional rights warranting liberties of the Basic Law of the Federal Republic of Germany. The principles theory of constitutional rights and findings of the theories of argumentation and coherence serve as theoretical fundament. In particular it deals with the issue of a reinforcement between constitutional rights. The jurisprudence of the Federal Constitutional Court and the legal literature are analysed with the background of the theoretical preliminary works. If this thesis succeeds, it offers a basis for further research in the area of constitutional rights concurrence and provides more clarity for the application of the law in cases of constitutional rights accumulation.
In vielen Fällen führt der Betroffene zu seinem Schutz mehr als nur ein Grundrecht ins Feld. Dann stellen sich Fragen der Grundrechtskonkurrenz. Die Arbeit ist ein Beitrag zur allgemeinen grundrechtlichen Konkurrenzdogmatik. Im Fokus steht das freiheitsrechtliche Grundrechtssystem des Grundgesetzes. Als theoretisches Fundament dienen die Prinzipientheorie der Grundrechte sowie argumentations- und kohärenztheoretische Erkenntnisse.
Insbesondere wird der Frage nachgegangen, ob eine Verstärkung zwischen konkurrierenden Grundrechten möglich ist. Die Rechtsprechung des Bundesverfassungsgerichts und die Vorschläge der Literatur zur Grundrechtskonkurrenz werden vor dem Hintergrund der theoretischen Vorarbeiten analysiert. Wenn die Arbeit gelungen ist, dann bietet sie sowohl die Grundlage für weitere Untersuchungen im Bereich der Grundrechtskonkurrenz als auch mehr Klarheit bei der Rechtsanwendung im Falle von Grundrechtshäufungen.
