englischThe thesis deals with the systematic differences and similarities between civil liability for cartel damages in Germany on one hand and tort liability in the German Civil Code on the other. Differences come to light here, as cartel liability has been increasingly extended by developments at the European level in order to maximise deterrence from cartel activities through a high threat of liability ("private enforcement"). The systematic comparison focuses in particular on the eligibility of indirect cartel victims within and outside the sales chain to claim damages, as well as the compensation of damages that occur far away from the cartel transaction.
