It provides an in-depth analysis of the criminal offense of bribery of elected officials according to Section 108e of the German Criminal Code. The examination covers the evolution of the provision and the international influences on it as well as its critical evaluation and suggestions for improvement. Additionally, it sheds light to the relevant non-criminal provisions and obligations for mandate holders. A comparative analysis of the relevant Greek norms rounds off the work.
Das Werk befasst sich mit der effektiven Regulierung politischer Korruption. Im Mittelpunkt steht die gründliche Analyse des Straftatbestands der Bestechlichkeit und Bestechung von Mandatsträgern nach § 108e StGB. Die Untersuchung erstreckt sich von der historischen Entwicklung der Norm und den internationalen Einflüssen darauf bis hin zu ihrer kritischen Bewertung und der Identifizierung von Verbesserungsansätzen. Zusätzlich werden die relevanten außerstrafrechtlichen Vorschriften und Pflichten für Mandatsträger beleuchtet. Eine rechtsvergleichende Darstellung der einschlägigen griechischen Rechtsnormen rundet die Arbeit ab.
