englischThe use of AI in medicine is revolutionizing healthcare, but also raises new liability issues. The author examines whether European product liability law is applicable to AI-based medical devices and can provide an appropriate balance of risks between manufacturers and users. For this purpose, all liability requirements are analyzed and a standard for defectiveness assessment of AI-based medical devices is defined, which takes into account both the characteristics of AI and the specifics of medical devices. In a postscript, the drafts of the new Product Liability Directive and the AI Liability Directive published by the European Commission at the end of 2022 are discussed.

Der Einsatz von KI in der Medizin revolutioniert das Gesundheitswesen, wirft jedoch auch neue Haftungsfragen auf. Die Autorin untersucht, ob das europäische Produkthaftungsrecht auf KI-basierte Medizinprodukte anwendbar ist und einen angemessenen Risikoausgleich zwischen Herstellern und Nutzern schaffen kann. Dazu werden alle Haftungsvoraussetzungen analysiert und ein Maßstab zur Bewertung der Fehlerhaftigkeit intelligenter Medizinprodukte aufgestellt, der sowohl den Charakteristika von KI als auch den Besonderheiten von Medizinprodukten Rechnung trägt. In einem Nachwort werden die Ende 2022 von der Europäischen Kommission veröffentlichten Entwürfe der neuen Produkthaftungsrichtlinie sowie der KI-Haftungsrichtlinie beleuchtet.
Die Arbeit wurde mit dem Wissenschaftspreis Medizinprodukterecht 2023 ausgezeichnet.
