englischThe work discusses a fundamental problem that exists due to the interpretation of Art. 263 (4) TFEU. This means that private individuals cannot take action against EU secondary legislation before the EU courts. The Federal Republic of Germany must close this legal protection gap due to the obligation under Art. 19 para. 1 subpara. 2 TEU. The general declaratory action pursuant to Section 43 (1) VwGO can be used for this purpose. With a constitutionally enforceable referral in accordance with Art. 267 para. 1 TFEU, the ECJ ultimately comes to the validity check.
