englischTo date, civil law studies on electricity storage are non-existent. The legal discourse ignores the fact that storage is confronted with a multitude of unresolved civil law problems, the dogmatic dimension of which is likely to exceed the significance of the energy law issues discussed to date. The origin of the problem is the recognition that energy does not fall under the concept of the thing in the German Civil Code, so that a large amount of the provisions of the German Civil Code, which are still directed at things, do not apply. The present study elaborates the civil law problems of electricity storage on the level of the law of obligations and on the level of the law of property, and develops initial recommendations.
