englischUsing UN documents analyzed for the first time and previously unpublished, the work presents the legal status of the "special case of Western Sahara" under international law and the resulting effects on international treaty law in a systematic, comprehensive and precise manner. On this basis, the work establishes principles, with particular attention to the European legal area and its case law, as to what extent natural resources of the territory can be exploited by third countries and how the right of self-determination of peoples works in this respect. The applicable legal framework has been examined with a particular focus on the provisions of international humanitarian law, which have yet received little ton o attention in this conflict.
