Die computergestützte Analyse von Inhalten im Wege des Text und Data Mining (TDM) soll rechtlich zulässig sein, auch wenn die Inhalte immaterialgüterrechtlich geschützt sind. Wie löst das Urheberrecht den Konflikt zwischen den Schutzinteressen der Rechteinhaber und dem Interesse von Wissenschaft und Wirtschaft an freier Forschung und Entwicklung? Während der europäische Gesetzgeber spezifische Schutzschranken für betroffene Immaterialgüterrechte geschaffen hat, richtet sich die Bewertung des TDM in den USA nach der Fair-Use-Generalklausel.
