Die verfassungsrechtliche Kontrolle von Europarecht im Kontext der Identitätskontrolle

englischThe study examines the constitutional review mechanism of identity review with particular consideration of the tension between extradition on the basis of a European Arrest Warrant and potentially conflicting principles of criminal constitutional law. At the same time it is analyzed whether the direct application of European Union fundamental rights by the Federal Constitutional Court in the context of a constitutional complaint could not be an approach to avoid the activation of the identity review and thus a violation of European Union Law. Against this background, a proposed solution for the future application of the identity review is developed.
Die Arbeit nimmt den verfassungsgerichtlichen Kontrollmechanismus der Identitätskontrolle unter besonderer Beachtung des Spannungsverhältnisses zwischen der Auslieferung aufgrund eines Europäischen Haftbefehls und potenziell entgegenstehender strafverfassungsrechtlicher Grundsätze in den Blick. Parallel dazu wird untersucht, ob nicht bereits mittels direkter Anwendung der Unionsgrundrechte durch das BVerfG im Rahmen einer Verfassungsbeschwerde ein Ansatz besteht, um eine Aktivierung der Identitätskontrolle und damit einen Verstoß gegen das Unionsrecht zu vermeiden. Vor diesem Hintergrund wird ein Lösungsvorschlag für die zukünftige Handhabung der Identitätskontrolle entwickelt.
