A physician's ethical obligation is to preserve life, cure disease, and alleviate suffering. However, the hope of cure is often accompanied by acceptance of the risks associated with medical intervention. The finding that physicians consciously decide to perform a life-threatening - in some cases fatal - operation not only gives rise to interesting dogmatic follow-up questions at the level of the elements of the crime and justification, but also at the same time reveals risks of criminal liability of not inconsiderable magnitude.
