Against this backdrop, this thesis analyses whether there is an inherent obstacle to state counterclaims in ICSID arbitration proceedings. To this end, the author analyses the prerequisites of jurisdiction and close connection. She systematises the existing case law and literature according to her own criteria and develops standards for the assessment of jurisdiction and close connection. This thesis is thus both a scholarly analysis of the topic as well as a handbook on counterclaims in ICSID arbitration proceedings, filling a gap in the literature.
Staaten erheben in Investitionsschiedsverfahren selten Widerklage. Auch wenn die Zahl der Widerklagen in den letzten Jahren anstieg, ist dieser Anstieg relativ verhalten. Vor diesem Hintergrund untersucht dieses Werk, ob es ein inhärentes Hindernis für staatliche Widerklagen in ICSID-Schiedsverfahren gibt. Hierzu analysiert die Autorin die Voraussetzungen der Zuständigkeit und der Konnexität. Sie systematisiert diesbezüglich die bisherige Rechtsprechung und Literatur anhand eigener Kriterien und arbeitet Maßstäbe zur Beurteilung der Zuständigkeit und der Konnexität heraus. Daher stellt diese Arbeit eine wissenschaftliche Analyse der Thematik sowie ein Handbuch zur Widerklage in ICSID-Schiedsverfahren dar und füllt eine Lücke im Schrifttum.
