englischFranz Merli is one of the few legal scholars to keep both a chronological and a systematic list of publications. The authors of the commemorative publication for his 65th birthday took this structure as a mandate to build on his contributions and positions. The result is a volume that thematically reflects Merli's work. The contributions deal with fundamental questions of democracy and the rule of law, they deal with key concepts of general administrative law and forms of administrative action, they examine current problems of administrative jurisdiction, administrative procedure and special administrative law, they look at European Union law and its interfaces with state law and take up questions of legal and constitutional theory.

Franz Merli zählt zu den wenigen Rechtswissenschaftler:innen, die neben einem chronologischen auch ein systematisches Verzeichnis der Veröffentlichungen führen. Dessen Gliederung nahmen die Autorinnen und Autoren der Festschrift zu seinem 65. Geburtstag als Auftrag, an seine Beiträge und Positionen anzuknüpfen. So ist ein Band entstanden, der Merlis Werk thematisch spiegelt. Die Beiträge behandeln Grundfragen der Demokratie und der Rechtsstaatlichkeit, sie setzen sich mit Schlüsselbegriffen des Allgemeinen Verwaltungsrechts und Handlungsformen der Verwaltung auseinander, sie gehen aktuellen Problemen der Verwaltungsgerichtsbarkeit, des Verwaltungsverfahrens und des Besonderen Verwaltungsrechts nach, sie nehmen das Unionsrecht und dessen Schnittstellen zum staatlichen Recht in den Blick und greifen rechts- und verfassungstheoretische Fragestellungen auf.
