englischEuropean Sales Law has always been an important topic from both the political and the academic perspective concerning European Private Law. Remedies are the centrepiece of the Sales Law. The thesis is an in-depth analysis of the structure and the content of the remedies in the Proposal of the European Commission for a Regulation on a Common European Sales Law (CESL). Whenever necessary, other (previous) legal texts as the Feasibility Study, the Draft Common Frame of Reference (DCFR), the Principles of European Contract Law (PECL), the Vienna Convention (CISG), directives for consumer protection, and the German Civil Code (BGB) have been taken into account.
The author is an assistant at the chair of Prof. Eva-Maria Kieninger at the University of Würzburg. The chair is specialized on German and European Private Law as well as Private International Law.
Das Thema des Europäischen Kaufrechts ist sowohl aus politischer als auch aus akademischer Sicht ein Dauerbrenner im Bereich der Entwicklung des Europäischen Privatrechts. Das Gewährleistungsrecht stellt insofern gleichsam das Herzstück des Kaufrechts dar. Die Arbeit behandelt umfassend die Struktur und den Inhalt des Gewährleistungsrechts im Verordnungsvorschlag der Europäischen Kommission über ein Gemeinsames Europäisches Kaufrecht (GEK). Wann immer es erforderlich ist, wird auf andere (Vorgänger-)Regelwerke, wie die Feasibility Study oder den Draft Common Frame of Reference (DCFR), die Principles of European Contract Law (PECL), das UN-Kaufrecht (CISG), das Richtlinienrecht zum Verbraucherschutz sowie das Bürgerliche Gesetzbuch (BGB) eingegangen.
Der Autor ist wissenschaftlicher Mitarbeiter am Lehrstuhl von Frau Prof. Eva-Maria Kieninger für deutsches und europäisches Privatrecht sowie Internationales Privatrecht an der Universität Würzburg.
