englischThe book provides a comprehensive overview of the possibilities and limits of content moderation on digital platforms. The author examines the national as well as the European legal framework and conducts an in-depth analysis of the relevant case law which has been growing dynamically since 2018. In his book, the author proposes to focus on the civil law basis of the contractual relationship between the user and the platform operator, and criticizes the highly constitutional approach of the Federal Court of Justice in connection with content moderation. Furthermore, the author addresses the provisions of the Digital Services Act and examines their impact on the applicability of national law.
