englischWith the approval of the 9th amendment to the GWB the German legislator has decided on an alignment with European cartel fine right. The new § 81 Abs. 3a GWB ties in with the European economic unit. This does not apply to German antitrust private law. In contrast to cartel fine right, there is no liability regardless of negligence in antitrust private law. The thesis examines the possibility of establishing the parent company´s liability for the cartel infringement of the subsidiary company de lege lata. As a result, civil liability in antitrust violation can be justified by means of an infringement of group-wide compliance regulations.
