englischWith about 250,000 patients annually, German inbound medical tourism has evolved from a niche phenomenon to a lucrative business segment for German healthcare providers over the past decades. In order to provide foreign patients with access to the German healthcare market, many clinics cooperate with so-called "patient agents" who assist patients in selecting a clinic and planning their stay. Whether and to what extent such cooperations are relevant under criminal law and how the cooperation is structured in practice is the subject of this work. By combining legal theory and empirical research, this work contributes to the further development of compliance in the healthcare sector.
