Rather, it is also crucial that fundamental legal principles may be transformed by the fact that the programming of digital actors leads to a temporal advance of human decisions that are relevant to legal interests. In addition, questions arise as to whether robots or digital machines can apply legal norms and violate legal norms. Closely related to this is the question of how programming machines can be reconstructed in terms of norm theory. These and other questions are the subject of the contributions collected in this volume.

Die Digitalisierung betrifft das Recht nicht nur deshalb, weil neue regelungsbedürftige Sachverhalte entstehen. Entscheidend ist vielmehr auch, dass sich grundlegende Rechtsprinzipien möglicherweise dadurch wandeln, dass die Programmierung digitaler Akteure zu einer zeitlichen Vorverlagerung rechtsgutsrelevanter menschlicher Entscheidungen führt. Darüber hinaus stellen sich die Fragen, ob Roboter bzw. digitale Maschinen Rechtsnormen anwenden und gegen Rechtsnormen verstoßen können. Eng hiermit hängt die Frage zusammen, wie eine Programmierung von Maschinen normentheoretisch rekonstruiert werden kann. Diese und weitere Fragen bilden den Gegenstand der in diesem Band versammelten Beiträge.
