englischWith the growing influence of digital forms of expression, their negative consequences become more and more apparent. They are increasingly used for the dissemination of hate speech. Consequently, the question arises to what extent the standards of the analogue world are also transferable to the digital world and whether special sets of rules are needed to counter the dangers of online expressions. The World Wide Web as a global means of communications and the intermediaries as global companies require a comparative legal consideration of universal and regional European international law, supranational EU law and national (German) constitutional law of these issues.
Mit dem wachsenden Einfluss digitaler Meinungsäußerungen werden auch deren negativen Konsequenzen immer deutlicher, denn sie werden vermehrt auch für die Verbreitung von Hassrede verwendet. Es stellt sich folglich die Frage, inwiefern die Standards der analogen Welt auch in der digitalen Welt übertragbar sind und ob es nicht spezieller Regelwerke zur Begegnung der Gefahren von Online-Meinungsäußerungen bedarf. Das World Wide Web als globales Kommunikationsmittel und die Intermediäre als globale Unternehmen erfordern eine rechtsvergleichende Betrachtung des universellen und regional-europäischen Völkerrechts, des supranationalen EU Rechts und des nationalen (deutschen) Verfassungsrechts dieser Fragen.
