englischThis work extends the discussion on the effectiveness of legal protection in public procurement, which has been continuously developed in case law and, in particular, in the literature and focuses on the special instrument of the public procurement block (also known as a “contract block”). Taking into account current literature and case law, the author examines whether and, if so, to what extent the legal remedies available to a blocked bidding company against the imposition of a public procurement block can meet the requirements of EU law and constitutional law regarding the effectiveness of legal protection. The author also focuses on the applicability of these legal protection standards to German public procurement law.
