englischThis thesis deals with product liability for software throughout the product life cycle. It examines not only the liability of software manufacturers, but also the liability of software intermediaries such as software distributors, platform operators (of app stores), host providers and importers, who are increasingly coming into focus as liability addressees. Once the abstract criteria have been developed, the product liability obligations of the actors are presented so that the work can also be used as a handbook. The work also addresses the Commission's proposal for a new Product Liability Directive (COM(2022) 495 final) and its impact on the liability examined.
Die Abhandlung widmet sich der Produkthaftung für Software entlang des Produktlebenszyklus. Dabei wird nicht nur die Haftung der Softwarehersteller untersucht, sondern auch die Haftung von Intermediären wie Softwarehändlern, Plattformbetreibern (etwa von App Stores), Hostprovidern und Importeuren, die als Haftungsadressaten zunehmend in den Fokus rücken. Nachdem zunächst die abstrakten Kriterien erarbeitet werden, folgt anschließend eine Darstellung der für die Praxis relevanten Pflichten der Akteure, sodass das Werk auch wie ein Handbuch genutzt werden kann. Zudem geht die Arbeit auf den Kommissionsvorschlag für eine neue Produkthaftungsrichtlinie (COM(2022) 495 final) und dessen Auswirkungen auf die untersuchte Haftung ein.
