englischIn the competition between operators of residential care homes, the quality of care is a special parameter. Religious organizations, such as Caritas and Diakonie, promise a special, individual quality of care. Following on from this, the study examines the extent to which the law of external quality control in inpatient care leaves the design of care quality to the home operators and allows the competition between home operators to be based on the parameter of quality. The study shows that the control instruments of the social care insurance law and the institutional care law are not always compatible and sometimes even contradict each other, and discusses questions about the constitutional legitimacy of the regulatory arrangement.
Im Wettbewerb der Heimträger um die Pflegebedürftigen ist die Qualität der Pflege ein besonderer Parameter. Vor allem religiöse Träger, wie Caritas und Diakonie, verheißen eine besondere, einrichtungsindividuelle Pflegequalität. Hieran anknüpfend untersucht die Arbeit, inwiefern das Recht der externen Qualitätssteuerung in der stationären Pflege die Gestaltung der Pflegequalität den Heimträgern überlässt und es die Ausrichtung des Wettbewerbs der Heimträger am Parameter der Qualität ermöglicht. Die Arbeit zeigt auf, dass die Steuerungsinstrumente des SGB XI und des Heimrechts nicht stets kompatibel sind und sich teils sogar widersprechen, und erörtert Fragen nach der verfassungsrechtlichen Legitimation des Regelungsarrangements.
