englischGerman family law is characterized by a rigid dualism of custody rights as the German family law legislator assigns custody rights to a maximum of two parents of a joint child. With this restriction, however, German law denies an assignment of custody to "social parents" such as step-parents and foster parents who in fact take care of the child. The author shows that the custody rights of social parents de lege lata do not take their needs sufficiently into account. She draws comparisons with the legal situation in England, identifies the need for reform on the basis of the comparative legal findings and presents possible solutions.
