englischThe importance of information liability in capital markets law is increasing rapidly, as the recent lawsuits due to incorrect ad hoc disclosure (e.g. in connection with the emissions scandal) show. At the same time, numerous questions regarding the basics, as with regard to different types of damages, and details, in particular the type of concrete loss calculation, remain unresolved. The work deals with these and other practical topics concerning substantive and procedural law. Based on findings from information economics, and taking a comparative law perspective, a concept is developed for determining investor losses using financial economic calculation models. The study focuses on the goal of economic efficiency without losing sight of pragmatic solutions.
