englischWith this investigation, the author derives a legal test for the prohibition of self-preferencing under Art. 102 TFEU. His analysis focuses on the Commission's decision in the "Google Search (Shopping)" case.

With the help of the typifying case comparison, differentiated factual characteristics can be named which, de lege lata, justify a prohibition of discriminatory leveraging, which, positively applied, represents a "duty to treat oneself equally".

This prohibition of discriminatory leveraging under Article 102 TFEU is also of independent importance in addition to the provisions on abusive self-preferencing contained in the draft DMA.
