englischThe author examines the legal classification and the constitutional limits of the state's use of artificial intelligence, specifically machine learning, to identify unknown crimes ("Smart Suspicion Generation"). According hereto, the Smart Suspicion Generation can lead to a suspicion in terms of criminal proceedings. The problem of opaque algorithms (black box) is resolved without explaining the "decision" of the Smart Suspicion Generation. The author provides a comprehensive analysis of discrimination and bias problems as well as reconcilability with the right to informational self-determination.
Die Untersuchung befasst sich mit der strafprozessualen Einordnung und den verfassungsrechtlichen Grenzen des staatlichen Einsatzes von Künstlicher Intelligenz (insbesondere des Maschinellen Lernens) zur Identifizierung von noch unbekannten Straftaten und Ordnungswidrigkeiten (kurz „smarte Verdachtsgewinnung“). Danach kann die smarte Verdachtsgewinnung zu einem strafprozessualen Verdacht führen. Die Problematik undurchsichtiger Algorithmen (Black-Box) wird überwunden, ohne die „Entscheidung“ der smarten Verdachtsgewinnung zu erklären. Diskriminierungs- und Bias-Probleme sowie die Vereinbarkeit mit dem Recht auf informationelle Selbstbestimmung analysiert der Autor umfassend.
